Terms and Conditions

Welcome to BE Creative Marketing TT (parent company Be Creative Studios Ltd.). By accessing our website or engaging our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Engagement of Services

All clients are required to sign a formal Service Contract before any project work begins. No work, including strategy development or filming, will commence until a signed agreement is in place and the required initial payment has been processed.

2. Payment Terms

• Downpayment: For all Content Creation services, a 50% non-refundable downpayment is required to secure your spot in our production schedule.
• Finality of Purchase: All purchases and payments made to BE Creative Marketing TT are final. We do not offer refunds for services rendered or for cancellations made after work has commenced.

3. Content Creation & Filming Window

To ensure efficiency and high-quality results, the following rules apply to all Content Creation contracts:

• Contract Duration: Content creation contracts are valid for a period of two (2) months from the date of the signed agreement.
• Client Responsibility: It is the client’s responsibility to make themselves, their business location, and/or their products available for filming within this 2-month window.
• Expiration of Contract: If the 2-month period lapses and the client has failed to provide access to the necessary people, locations, or products required for filming, the contract will be considered fulfilled and ended.
• No Refunds for Non-Availability: In the event of a contract lapse due to client non-availability, the client is not entitled to a refund of the downpayment or any other fees paid.

4. Creator Rights & Portfolio Usage

By working with BE Creative Marketing TT, you grant us the following rights:

• Promotional Usage: We reserve the right to share and/or post any version of your project, including initial drafts, behind-the-scenes footage, and final copies.
• Multi-Platform Distribution: Your content may be featured across multiple social media platforms (Instagram, TikTok, Facebook, etc.) and on our official website for the purpose of promoting our brand and showcasing our portfolio.
• Attribution: We may identify you or your business as the client in these promotional posts unless a Non-Disclosure Agreement (NDA) is signed and agreed upon prior to the start of the project.

5. Limitation of Liability

BE Creative Marketing TT will not be held liable for any indirect, incidental, or consequential damages resulting from the use of our services or the performance of the content produced. While we strive for “Results That Sell,” we do not guarantee specific sales figures or viral growth, as social media performance is subject to platform algorithms.

6. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Trinidad and Tobago. Any disputes arising from these terms shall be resolved in the courts of Port-of-Spain.
